Under an ill-conceived law approved by the Florida legislature in 2006 in Florida, private utility companies are allowed to collect funds, in the form of rate increases to their customers, to pay the advance costs for nuclear power plant construction. These funds can be collected even if the nuclear projects have not yet been licensed and approved by state and federal regulatory agencies, and if the projects are not approved. If the nuclear plants are canceled by the utilities for any reason, the corporations can pocket the millions they have fleeced from their customers, all with permission from the state. "Granting FPL and Progress Energy permission to raise utility rates to pay for risky and unnecessary nuclear plants is like giving them a license to steal," said Michael Canney, GPF spokesperson and representative in a Petition to Intervene in the federal licensing process for the Levy County nuclear plant. "Nuclear cost recovery is a form of corporate welfare designed to "fast track" nuclear power development and guarantee industry profits at the expense of the public interest. The PSC has become a rubber stamp for the nuclear power industry."

Progress Energy Florida's proposal to build a new dual-reactor nuclear power plant in Levy County was challenged in February when the Green Party of Florida (GPF) joined with the Nuclear Information and Resource Service (NIRS) and the Ecology Party to file a Petition to Intervene in the Nuclear Regulatory Commission's licensing process for PEF's Construction and Operating License Application.
On Wednesday July 8, after months of deliberation, a three-judge Atomic Safety Licensing Board panel issued a 112-page order ruling that the Petitioners had submitted valid and admissible "contentions" regarding the proposed plant's environmental impact that deserve a legal hearing. These days it seems everybody is "going green." Real concern for climate change and the environment, however, has to go beyond slogans and bullet points designed to look good and make a buck.  This affects us all. We can't solve anything if it's only for some, and it's run by greed. That's what brought us here in the first place. That and complacency. Then there's something called misinformation. The lack of a committed media. A shortage of proper education. The list goes on...
